NOTICE
NOTICE IS HEREBY GIVEN that the Willistown Township Zoning Hearing Board will meet on Tuesday, March 31, 2026, at 7:00 p.m., prevailing time, at the offices of the Township located at 688 Sugartown Road, Malvern, Willistown Township, Chester County, Pennsylvania, to conduct such business as may properly come before the Board and to hold a hearing on the following:
Application Z-14-24: The amended Application of HK Industrial Blvd LLC, asserts a substantive validity challenge to §§73-13.A(1)(a), 73-13.A(1)(b) and 73-11.1(F) of the Willistown Township Environmental Protection Ordinance (EPO), which has been incorporated by reference into the Township’s Zoning Ordinance, and §139-107.B (Conservation requirements) of the Zoning Ordinance; and, in the alternative, seeks variances from §139-107.A (Conservation requirements), of the Zoning Ordinance, which incorporates the provisions of Chapter 73, Environmental Protection, Article III (Conservation Plan Requirements) of the Willistown Township Code, as follows: §73-13.A(1)(a) to permit the disturbance of 66.8% of trees having a caliper of six inches or greater existing on the lot, where only 25% of such trees are permitted to be disturbed; §73-13.A(1)(b) to permit the proposed landscaping plan (including 412 new trees and 508 new shrubs), where the ordinance otherwise would necessitate the planting of 423 trees with a caliper of five inches or greater; and §73-11.1(F) which provides that no more than 50% of an individual lot may be comprised of protected lands; and §139-107.B (Conservation requirements) of the Zoning Ordinance to permit the removal of 47 trees of desirable species with trunks greater than 18 inches in circumference at chest height, where otherwise not permitted, for the proposed development of the property located at 14 Industrial Boulevard, being UPI No. 54-1-2.17, in the I – Restricted Industrial District; and such further relief as may be necessary.
