NOTICE IS HEREBY GIVEN that the Willistown Township Zoning Hearing Board will meet on Wednesday, July 30, 2025, at 7:00 p.m., prevailing time, at the offices of the Township located at 688 Sugartown Road, Malvern, Willistown Township, Chester County, Pennsylvania, to conduct such business as may properly come before the Board and to hold a hearing on the following:
Application Z-13-24: Application of Robert and Sharon Moffett, which appeals a Zoning Officer determination pursuant to §139-123 (Functions: appeals from Zoning Officer) of the Willistown Township Zoning Ordinance regarding a Notice of Code Violation issued on September 10, 2024. Alternatively, the Applicants seek a variance from §139-94.A(1)(Yard exception for accessory uses and buildings) to permit an accessory structure that is located within 20 feet from the property line to remain on the property where it is otherwise not permitted to be located; variances from §139-94.B to permit an accessory structure that has a footprint that exceeds 150 square feet to be remain within the required yards on the property where it is otherwise not permitted, and to permit more than 2 accessory structures to remain on the property where 2 accessory structures is the maximum permitted; a variance from §139-97.C (Prohibited uses) to permit a structure for the housing of horses, or similar animals, on a lot less than 4 acres and to permit the keeping of 3 horses, or similar type animals, on a lot with less than 2 acres of dedicated pasture land, where it is otherwise not permitted; and a variance from §139-105.B (Fences or walls) to permit a fence that exceeds six feet in height to remain on the property where the maximum permitted fence height is six feet; for the property located at 19 Smedley Drive, being UPI No. 54-8-64.15, which is located in the RA – Residence District; and such further relief as may be necessary. The Board previously conducted the final hearing on this matter on June 25, 2025 and the record was closed. No further testimony will be received. The Board will render a decision on this Application.
Application Z-9-25: Application of Robert Leboffe and Kathleen Nelling, which seeks a variance from §139-23.C(2)(Side yards) of the Willistown Township Zoning Ordinance to permit an existing detached garage to remain in its current location on the property, where it encroaches approximately 36.1 feet into the required 40 foot side yard setback, for the property located at 4 Powderhorn Lane, Newtown Square, being UPI No. 54-8-35.14, in the RA – 1 Residence District; and such further relief as may be necessary.
