WILLISTOWN TOWNSHIP ZONING HEARING BOARD
October 26, 2022 7:30 p.m.
AGENDA

1. Settlement Agreement and Mutual Release between Ryan Heenan, Lori Heenan and Westview Capital Investments LLC and Robert M. Steidle, Yolanda Gray, Ethel Ziselman, Leslie J. Green, Franklin and Ann Marie Houder, Michael and Tana Wall, Willistown Township, and the Willistown Township Zoning Hearing Board. Proposed Agreement will resolve Application Z-2-22, a substantive validity challenge to the Township’s Zoning Ordinance currently pending before the ZHB, as well as Steidle et al v. ZHB, pending before the Chester County Court of Common Pleas at docket no. 2021-08423-ZB, appealing the ZHB’s decision in Application Z-6-21, among other litigation and threatened litigation.

2. Application Z-10-22: Application of Alliance Housing Development, LLC which seeks a variance from §139-98.G (Residential parking requirements) of the Willistown Township Zoning Ordinance to permit the proposed construction of an age-restricted apartment development with approximately 108 dwelling units in two 3-story buildings which will provide one parking space per dwelling unit where two parking spaces per dwelling unit are required. The Applicant is the equitable owner of the properties located at 27-29 Industrial Boulevard, being UPI Nos. 54-1-2.12 and 54-1-2.13, in the I – Restricted Industrial District; and such further relief as may be necessary. Record closed following the hearing on September 28, 2022. Board to render decision.

3. Application Z-11-22: Application of Lisa Nicoletti and Thomas Caslin which seeks a variance from §139-159 (Riparian Buffer Area (RBA) Conservation District) of the Zoning Ordinance, which incorporates the provisions of Chapter 73, Environmental Protection, Article XII (Riparian Buffer Area (RBA) Conservation District) of the Willistown Township Code, to permit the construction of an approximately 578 square feet garage addition and a driveway reconfiguration within the Zone 2 Riparian Buffer Area where they are not otherwise permitted under §73-62.B.(1) (Permitted uses). Applicants also seek a special exception, pursuant to §139-90.B(2) (Extension), to permit the extension of the existing residential garage, which is a nonconforming building, for the property located at 4 Post Road, being UPI No. 54-3-338.16, in the R-1 Residence District; and such further relief as may be necessary.
