PUBLIC NOTICE

 NOTICE IS GIVEN that the Board of Supervisors of Willistown Township will hold a public hearing regarding the following ordinance during its normal public meeting on March 13, 2023, at 7:00 PM at the Township Municipal Building located at 688 Sugartown Road, Malvern, PA  19335. Following the public hearing, the Board will consider enactment of the proposed ordinance. A full text copy of the ordinance is available for public examination without charge or may be obtained for a charge not greater than the cost thereof at the Municipal Building. The preamble and a brief summary prepared by the solicitor listing the provisions in reasonable detail follows:

 AN ORDINANCE PURSUANT TO THE PENNSYLVANIA MUNICIPALITIES PLANNING CODE, AMENDING CHAPTERS 139, 73 AND 123 OF THE CODE OF ORDINANCES OF WILLISTOWN TOWNSHIP, BEING THE WILLISTOWN TOWNSHIP ZONING ORDINANCE, THE WILLISTOWN TOWNSHIP ENVIRONMENTAL PROTECTION ORDINANCE AND THE WILLISTOWN TOWNSHIP SUBDIVISION AND LAND DEVELOPMENT ORDINANCE, BY DEFINING VARIOUS TERMS; BY CORRECTING SEVERAL SECTION REFERENCES; BY AMENDING PERMITTED USES WITHIN THE RU RURAL DISTRICT; BY ADDING SPECIFIC STRUCTURES PERMITTED WITHIN A REDUCED SETBACK; BY AMENDING THE SIGN SECTION TO PERMIT WALL SIGNS ON BUILDINGS WITH MULTIPLE STREET FRONTAGES; BY REQUIRING ADDITIONAL DETAIL TO ZONING PERMITS; BY AMENDING THE DELINEATION AND DEFINITION OF PROHIBITIVE AND PRECAUTIONARY SLOPES; AND BY AMENDING DESIGN STANDARDS FOR CUL-DE-SAC TURNAROUNDS.

 Section 1.        Amends § 139-6 of the Willistown Township Zoning Ordinance (“Zoning Ordinance”), title “Definitions”, by revising or creating definitions for Building Area/Coverage, Dwelling Unit, Impervious Surface, and No-Impact Home Occupation.

Section 2.        Amends § 139-94 of the Zoning Ordinance, titled “Yard Exception for Accessory Uses and Buildings”, to amend the regulations for accessory structures and buildings within a side or rear yard setback.

Section 3.        Amends § 139-103 of the Zoning Ordinance, titled “Front Yard Exception”, by amending the regulations for porches in a front yard in the R-3 District.

Section 4.        Amends § 139-110, titled “Use and Location Requirements”, by revising the regulations for wall and ground signs on property with frontage on 2 streets.

Section 5.        Amends § 139-110.1, titled “Standards for Signs Based on Type of Construction”, by revising the regulations for wall signs on property with frontage on 2 streets.

Section 6.        Amends § 139-113, titled “Zoning Permits”, by amending the requirements for site plans to be submitted with zoning permit applications.

Section 7.        Amends § 139-118.1, titled “Applications for Conditional Use Approval”, by amending the notice requirements for conditional use applications.

Section 8.        Amends § 139-154, titled “Common Open Space Standards”, by replacing “farm use” with “agriculture”.

Section 9.        Amends § 73-31 of the Willistown Township Environmental Protection Ordinance, titled “Designation and Interpretation of District Boundaries”, by revising regulations relating to prohibitive and precautionary slopes.

Section 10.      Amends § 123-24 of the Willistown Township Subdivision and Land Development Ordinance, titled “Cul-de-sac and Other Single-Access Streets”, by revising regulations for cartways, islands, and parking on cul-de-sacs.

Section 11.      Provides for a severability provision.

Section 12.      Effective five (5) days from the date of enactment.

Section 13.      Provides for a repealer provision.
