Public Notice

AN ORDINANCE AMENDING CHAPTER 139 OF THE CODE OF ORDINANCES OF WILLISTOWN TOWNSHIP, BEING THE ZONING ORDINANCE, IN ORDER TO PROVIDE FOR USES PERMITTED UNDER PENNSYLVANIA ACT 16 OF 2016, THE MEDICAL MARIJUANA ACT. EFFECTIVE FIVE DAYS FROM ENACTMENT.

Section 1 adds the following terms and definitions to § 139-6 of the Zoning Ordinance: “DISPENSARY, MEDICAL MARIJUANA” and “GROWER/PROCESSOR, MEDICAL MARIJUANA”.

Section 2 amends the Code of the Township of Willistown, Chapter 139, Article XXXIII, C-I Commercial Industrial Overlay District, § 139-193, permitted conditional uses is amended by adding two new sections J and K entitled: “J. medical marijuana grower/processors.” and “K. medical marijuana dispensaries.”.

Section 3 amends the Code of the Township of Willistown, Chapter 139, Article XXXIII, C-I Commercial Industrial Overlay District, § 139-195, by adding a new section U which imposes specific requirements on medical marijuana growers/processors including: assessment of additional tapping or rate fees for water and sewer pursuant to anticipated service demands; provision of adequate policing to prevent unintended transfers of marijuana plants off premises; limitation on the number of growers on any site; acquisition of state operation permits as a perquisite to issuance of an occupancy permit; and provisions for off-street parking and loading.

Section 4 amends the Code of the Township of Willistown, Chapter 139, Article XXXIII, C-I Commercial Industrial Overlay District, § 139-195, by adding a new section V which imposes specific requirements for medical marijuana dispensaries including: no dispensaries shall be permitted within 1,000 feet of a school or daycare center; the site must provide adequate policing to prevent sales of medical marijuana products other than for state-licensed medical reasons; limitation of one dispensary per site or building; acquisition of state operation permits as a perquisite to issuance of an occupancy permit; and provisions for off-street parking and loading.

Section 5 sets forth that this Ordinance shall be effective five (5) days from the date of enactment.
